The Estate Planning Council of San Bernardino County is pleased to welcome Dr. Robert Sawicky to the February virtual meeting to share his perspective on capacity and undue influence.
It might be said, "Capacity is the ever-present elephant in the room." This presentation will explore how the concept of capacity invites itself into the Probate Courtoom, the LPS Courtroom and the Criminal Courtroom. In addition, the process of assessing "Undue Influence" will be considered and how the issue of capacity might play a role in such an assessment.
